General Terms and Conditions
Scope
- These Terms and Conditions apply to contracts for the rental of hotel rooms for accommodation as well as all other services and deliveries provided to the customer by the hotel.
- Subletting or further renting of the rooms provided, as well as their use for purposes other than accommodation, requires the prior written consent of the hotel in text form. In this regard, Section 540 (1) sentence 2 of the German Civil Code (BGB) is hereby excluded to the extent that the customer is not a consumer.
- The customer’s general terms and conditions shall only apply if their applicability has been expressly agreed in writing in advance.
Conclusion of Contract, Contracting Parties, Limitation Period
Contracting parties are the hotel and the customer. The contract is concluded when the hotel accepts the customer’s application. It is at the hotel’s discretion to confirm the room reservation in writing.
All claims against the hotel generally become time-barred one year after the legal commencement of the limitation period. This does not apply to claims for damages or other claims insofar as they are based on intentional or grossly negligent breach of duty by the hotel.
Services, Prices, Payment, Set-off
The hotel is obliged to keep the rooms booked by the customer available and to provide the agreed services.
The customer is obliged to pay the hotel’s applicable or agreed prices for the room rental and any additional services they have used. This also applies to services arranged directly by the customer or via the hotel that are provided by third parties and for which the hotel has advanced payment.
The agreed prices include the taxes and local fees applicable at the time of contract conclusion. If statutory value-added tax changes or local fees on the subject matter of the service are newly introduced, changed, or abolished after contract conclusion, the prices will be adjusted accordingly. In contracts with consumers, this shall only apply if the period between contract conclusion and contract fulfillment exceeds four months.
The hotel may make its consent to a reduction requested by the customer—whether in the number of rooms booked, the hotel’s services, or the duration of the customer’s stay—contingent on a corresponding increase in the price for the rooms and/or the hotel’s other services.
Invoices from the hotel without a due date are payable within 10 days of receipt of the invoice without deduction. The hotel is entitled to declare accrued claims due at any time and demand immediate payment. In the event of default in payment, the hotel is entitled to charge the statutory default interest currently at 8 % above the base rate for commercial transactions, or at 5 % above the base rate for consumer transactions. The hotel reserves the right to prove a higher loss.
The customer may only set off or apply a counterclaim against a claim of the hotel if such counterclaim is undisputed or legally established.
The hotel reserves the right to preauthorize credit cards prior to arrival.
Cancellation Policy
A free cancellation of individual bookings is possible up to 24 hours before arrival. Group reservations can be canceled free of charge up to 28 days before arrival. Reservations not canceled in time will be charged in full.
